Acceptance of Terms

These Terms & Conditions govern your use of the Clutch City Cluckers website, online ordering, catering, loyalty program, and related services. The SMS/Text Messaging Program section applies only to users who separately and voluntarily opt in to receive SMS messages. SMS consent is not required to use our website, place an order, request catering, join loyalty, or use our services.

Eligibility

You must be at least 13 years old to use the Services. Some features (including SMS marketing) require you to be at least 18 years old or the age of majority in your jurisdiction.

Orders, Pricing & Catering

  • All prices are listed in U.S. dollars and may change without notice.
  • Orders are subject to availability and acceptance by the fulfilling location.
  • Catering orders require advance notice and may be subject to minimum order values and cancellation policies disclosed at checkout.
  • Delivery and third-party platform (DoorDash, ChowNow, Uber Eats, EZCater) orders are also subject to those providers’ terms.

Cluckers Club / Loyalty Program

Loyalty points and rewards have no cash value, are non-transferable, and may expire. We may modify or terminate the program at any time.

SMS / Text Messaging Program

The Clutch City Cluckers SMS program is a voluntary promotional messaging program. Users may opt in by submitting the standalone SMS signup form and checking the separate optional SMS consent checkbox.

By opting in, you agree to receive recurring promotional text messages from Clutch City Cluckers, including offers, discounts, coupons, store updates, catering promotions, loyalty offers, and limited-time deals.

Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time. Reply HELP for help.

Consent to receive SMS messages is not a condition of purchase or use of our services. You may place orders, request catering, browse our website, join loyalty, and use our services without subscribing to SMS messages.

We do not sell, rent, or share mobile numbers or SMS consent data with third parties or affiliates for marketing or promotional purposes. Mobile information is only shared with service providers strictly necessary to deliver the SMS messages you requested, and they are not permitted to use that information for any other purpose.

You agree not to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose.
  • Submit false, misleading, or another person’s contact information.
  • Attempt to disrupt, reverse engineer, or gain unauthorized access to the Services.

Menu items and allergens are described to the best of our knowledge; please contact us with any allergy concerns before ordering.

Limitation of Liability

To the maximum extent permitted by law, Clutch City Cluckers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. Our total liability for any claim will not exceed the amount you paid us in the 6 months preceding the claim.

You agree to indemnify and hold harmless Clutch City Cluckers, its franchisees, employees, and agents from any claims arising from your misuse of the Services or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Exclusive jurisdiction and venue shall lie in the state and federal courts located in Harris County, Texas.
